LEGAL SHOWDOWN OVER KENYA’S HAITI MISSION

Today, the High Court is set to decide on Thirdway Alliance party leader Ekuru Aukot’s legal challenge against deploying officers to Haiti for a peacekeeping mission. 

On 24 October 2023, High Court Judge, Justice Chacha Mwita extended an order halting the deployment after Aukot’s lawsuit, filed on october 06, 2023, concludes. The lawsuit aimed at preventing the President’s directive of sending a peacekeeping mission of over 1,000 police officers to address the security challenges in gang-ridden Haiti. Mr. Aukot, argues that Kenya lacks ratified laws or treaties allowing such deployments.

Aukot contends that Kenya has no ratified laws permitting officers’ deployment abroad, raising constitutional and international concerns. 

The lawsuit also questions the legal framework governing Kenya’s role in international peacekeeping, addressing potential executive overreach. 

Today’s court decision will shape Kenya’s future in global peacekeeping.
