 Acting Inspector General of Police Gilbert Masengeli has been convicted of contempt of court for failing to honour a court summons. Justice Lawrence Mugambi delivered the verdict on Monday, September 9, 2024, stating that Masengeli’s conduct had undermined public confidence in the judiciary and that state officers must adhere strictly to constitutional duties.

During the court proceedings, Justice Mugambi emphasized the importance of upholding the constitution and the role of the judiciary in ensuring public trust. The court highlighted Masengeli’s repeated absences as a form of defiance that held the judiciary at ransom.

Masengeli’s sentencing is scheduled for Friday, September 13, 2024. His no-show in court has drawn sharp criticism from various quarters. State counsel representing Masengeli argued that the Acting IG was currently engaged in operational activities in Wajir, rendering him unable to attend the court session. Despite Masengeli’s request for an extension due to his official duties in Mombasa, the court was not swayed.

The petitioners, represented by lawyer Nelson Havi, have been vocal about the need for severe consequences due to Masengeli’s apparent disregard for court orders. Havi expressed frustration over Masengeli’s repeated absences, questioning the limits of the court’s tolerance for such behaviour. He further criticized Masengeli’s apparent priorities, suggesting that his attendance at a concert instead of complying with court orders was “shameful.”

Adding to the criticism, Faith Odhiambo, President of the Law Society of Kenya (LSK), supported Havi’s position. Odhiambo dismissed the reasons provided by Masengeli for his absence as insufficient.

The case has also attracted attention due to the ongoing investigation into the disappearance of three individuals: Jamil Longton, his brother Aslam Longton, and activist Bob Njagi. These individuals were reportedly abducted by persons believed to be police officers during the Gen Z protests on August 19, 2024. The court had summoned Masengeli to provide explanations regarding their whereabouts.

The situation has further intensified calls for accountability within the police force and has sparked a broader debate about the adherence to legal and constitutional obligations by high-ranking state officials. As Masengeli awaits sentencing, the case continues to be a focal point of public and legal scrutiny.
