High Court judge Weldon Korir has ruled in favour of The Kenya National Union of Nurses and The Pharmaceutical Society of Kenya, as he has declared sections, 16, 17 and 33 of the Health Act, 2017, unconstitutional and discriminatory. This has paved way for Pharmacists and Nurses to head Hospitals, a position that was limited to medical doctors only.

The judge found it unreasonable and unfair to treat healthcare providers and healthcare professionals differently, yet they all serve in the same healthcare system with the aim of attaining the goals as identified in the Health Act, 2017.

According to his view, quality and affordable healthcare required a holistic approach thus collective efforts from health care providers and not divide and rule.
