Blow to Gachagua as Court Declines to Halt Impeachment Proceedings

Deputy President Rigathi Gachagua suffered another setback as the High Court, for the second time, declined to issue orders to stop the impeachment proceedings against him.

A petition filed by former senator Cleophas Malala was mentioned on Monday, October 7, before Justice Bahati Mwamuye. However, Justice Mwamuye directed that the case be placed before the presiding judge of the High Court, Justice Chacha Mwita, for further directions.

Meanwhile, the National Assembly has filed an application seeking to consolidate all petitions challenging the impeachment process. The assembly argued that since the petitions address similar issues, consolidating them would allow for more efficient handling and resolution.

“There are currently thirteen (13) petitions before the High Court in Nairobi and other stations across the country, all challenging the impeachment of Deputy President Rigathi Gachagua,” reads the National Assembly’s application.

Malala’s petition also raised concerns regarding the constitutionality of the bicameral Parliament (National Assembly and Senate), arguing that it does not meet the required two-thirds gender rule.

Gachagua has been facing mounting legal challenges, with his impeachment proceedings attracting national attention.
